Rutland Dundee Fire Protection District news

The Rutland Dundee Fire Protection District is seeking a court order to end its contract with the West Dundee Fire Protection District, which involves providing fire and ambulance services to around 30 homes. The district claims that its residents are unfairly subsidizing these services, paying three times more than those in West Dundee.

Rutland officials argue that the original agreement, signed in 2004, was approved by board members who are no longer in office. They claim this makes the current board not legally bound by the terms of the contract.

The contract originally cost $7,500 per year, but due to inflation, it's now approximately $12,000 annually. According to the lawsuit filed in Kane County, the West Dundee Fire Protection District is a group of luxury homes located near Frontenac Drive and Boncosky Road, just west of Route 31. It exists as a taxing body on paper, but under state law, it can still contract for emergency services.

Tom Gilbert, the attorney for the West Dundee Fire Protection District, said the deal should be honored, as it’s set to expire in April 2020. He emphasized that while the contract has been updated over the years, Rutland residents are currently paying the maximum allowed under the Property Tax Limitation Act, resulting in a rate three times higher than what West Dundee residents pay.

“It’s the deal they made,” Gilbert said. “We intend to stick with the agreement.”

The lawsuit also points out that all the Rutland fire trustees who initially signed the contract and later revised it are no longer on the board. This, according to the plaintiffs, means the current board is not obligated to follow the existing terms.

If the court decides to terminate the contract, several outcomes could follow. The most immediate would be the West Dundee Fire Protection District either entering into a new agreement with Rutland at a higher cost or seeking services from another district altogether.

Previously, the West Dundee Fire Protection District had a contract with the village of West Dundee for fire services in the early 2000s. However, when the village proposed an increase, they opted to sign the 2004 deal with Rutland instead.

A hearing is scheduled for August 13, where both sides will present their arguments before a judge.
