Rutland Dundee Fire Protection District news

The Rutland Dundee Fire Protection District is seeking legal action to end a long-standing contract that requires it to provide fire and ambulance services to roughly 30 homes in the West Dundee Fire Protection District.

In their lawsuit, filed in Kane County, Rutland officials claim that their residents are being unfairly burdened by paying three times more than those in West Dundee for the same services. They argue that the original agreement, approved back in 2004, was last modified by board members who are no longer in office, making it invalid under current leadership.

The 2004 contract stipulated that Rutland would provide fire and ambulance services for an annual fee of $7,500. The West Dundee Fire Protection District consists of upscale homes located off Frontenac Drive and Boncosky Road, just west of Route 31. While it’s recognized as a taxing body, it exists mostly on paper and is legally allowed to contract for emergency services under state law.

Tom Gilbert, attorney for the West Dundee Fire Protection District, maintains that Rutland should honor the agreement, which is set to expire in April 2020. He points out that the original $7,500 deal has been adjusted for inflation over the years and now costs around $12,000 annually. “It’s the deal they made,” he said, emphasizing that the district plans to stick with the terms.

Rutland, however, argues that none of the current fire trustees signed the original contract or its amendments, meaning the current board isn’t legally bound by it. If the court rules in favor of Rutland, several possibilities could arise: the West Dundee district may seek services from another fire protection district or negotiate a new, more expensive contract with Rutland.

Historically, the West Dundee Fire Protection District had contracted with the village of West Dundee for fire services in the early 2000s. However, when the village requested a rate increase, the district switched to Rutland in 2004.

The case is set to go before a judge on August 13, with both sides preparing for a legal showdown over the future of this service agreement.
